Heard learned counsel for the Parties.

The Writ Petition involves the following prayer: "Under the above facts and circumstances this Hon'ble Court may graciously be pleased to issue Rule NISI by calling upon the Opposite Parties more particularly the Opposite Party No.2 and 3 to show cause as to why the encroachers i.e. the opposite Party No.4 to 7 shall not be evicted from the Government Land of kissam "Abadajogya Anabadi" vide Khata No.461, Plot No.936 & Plot No.938 in Mouza Medhapada under Bailapal Block in the district of Balasore as they are illegally/ forcefully encroached the Government land and if they fail to show cause or insufficient cause the rule be made absolute. And further be pleased to issue Rule a Writ of Mandamus by directing the Opposite Party No.3 i.e. the Tahasildar Baliapal to take immediate action on the representation of the petitioners' dt.12.01.2021 within a stipulated time period in accordance with Law for the interest of justice.

And further be pleased to issue any other Writ(s), or pass any order(s) as this Hon'ble Court may deem just and proper in the eye of law.

And for this act of your kindness the petitioners shall as in duty bound remain ever pray."

For similar nature of request pending before the TahasildarCum-Revenue Officer, Baliapal- Opposite Party No.3, the Opposite Party No.3 is directed to look into the request of the Petitioner and take necessary action following the provision of O.P.L.E. Act. Action, if any be taken within a period of three months but however involving the Parties likely to be affected.
