The petitioner in this application under Section 482 of the Code of Criminal Procedure (for short "Cr.P.C.") has prayed for dropping the F.I.R. vide Baseli Sahi (Puri) P.S. Case No.90 of 2009 lodged at her instance.

Heard the learned counsel for the petitioner and the learned counsel for the State.

Since the case is pending since long and investigation has not been concluded and expeditious investigation is one of the facets of the fundamental right under Article 21 of the Constitution of India, this Court without entertaining the prayer made in this petition to drop the F.I.R. on the ground of delay

// 2 // in investigation by the informant, which is nothing but fallacious one and for the reasons best known to the Informantpetitioner that she has come with such prayer, this Court directs the Investigating Officer in Baseli Sahi (Puri) P.S. Case No.90 of 2009 to take all effective steps to file a report under Section 173 of Cr.P.C. not later than two months of receipt of the certified copy of this order.

With the aforesaid order, this CRLMC stands disposed of.

A free copy of this order be handed over to the learned counsel for the State.
