1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. A. Mishra, learned counsel for the Petitioner and Mr. R.N. Mishra, learned AGA appearing for the Opp. Parties.

3. It is submitted that after his retirement from service w.e.f.30.11.2020 the Petitioner was not released with his pensionary benefits basing on the communication issued under Annexure-4, 5 & 6. It is submitted that as on the date of retirement of the Petitioner no proceeding whatsoever was there against the Petitioner and accordingly the Petitioner is entitled to get his retirement benefits.

4. On instruction Mr. Mishra, learned AGA also fairly submitted that not only as on date of retirement, but also as on today no proceeding is pending against the Petitioner.

5. In view of such submission made by learned counsel appearing for the Parties, this Court directs the Opp. Parties to release the pension and pensionary benefits as due and admissible in favour of the Petitioner within a period of two (2) months from the date of

// 2 // receipt of this order. However, it is observed that the Opp. Parties may initiate any proceeding, if it is so permissible in the eye of law.

6. The writ Petition is disposed of with the aforesaid observation and directions.
