This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and the learned Additional Standing Counsel. Perused the records. 3.

This is an application under Section 438 Cr.P.C. filed by the Petitioner for anticipatory bail.

Learned counsel for the Petitioner submits that the Petitioner is no way connected with the present case and during investigation Police seized the vehicle from one Rama Chandra Behera and Mantu Senapati and the Petitioner happens to be one of the friends of the aforesaid persons.

Considering the nature of allegations made, gravity of the offence and the fact of the case, I am not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before the learned J.M.FC.(R), Cuttack in G.R.Case No.1653 of 2021 arising out of Tangi P.S.Case

// 2 // No.129 of 2021 within a period of three weeks from today and moves for bail, he shall be released on bail on such terms and conditions as would be deemed just and proper by the learned Magistrate and subject to verification of criminal antecedents. In the event it is found that the Petitioner has more than one criminal antecedent then the present order shall stand revoked. It is also directed the Petitioner to appear before the concerned Police Station in a fortnight on Sunday between 10 to 1 P.M. till the end of trial.

The ABLAPL is accordingly disposed of.
