Heard learned counsel for the Parties.

The Writ Petition involves the following prayer: "It is therefore, prayed that in the facts and circumstances stated above and in the interest of justice, Your Lordships would be graciously pleased to direct the Opp. Parties No.2 to 4 to work out the recommendation of Site Selection Committee dated 20.12.2010 and continue construction of Panchayat Office of Gadabalabhadrapur Gram Panchayat exclusively over the site selected vide Annexure-2;

And/ or pass any such other order/orders as may deem just and proper;

And, for this Act of kindness, the petitioners shall as in duty bound ever pray."

In course of submission, it is noticed that Petitioners have already a claim on the self-same issue pending before the Collector & District Magistrate, Puri- Opposite Party No.2 vide Annexure-9. 4.

Considering the case is to be a pending case before the Opposite Party No.2, this Court in disposal of the Writ Petition directs the Opposite Party No.2 to consider the claim of the Petitioners vide Annexure-9 and take decision by completing entire exercise within a

// 2 // period of eight weeks, Petitioners seek clam benefit through the Judgment of this Court in W.P.(C) Nos. 6432 & 21661 of 2018 & 4548 of 2019 decided on 09.04.2019. This Court observes in undertaking the exercise, the Collector & District Magistrate, Puri shall examine the applicability of the judgment and take decision, as appropriate. 5.

Learned counsel for the Petitioners is directed to serve copy of this Writ, copy of this order and copy of this judgement on the Collector & District Magistrate, Puri- Opposite Party No.2 within a period of ten days hence.
