This matter is taken up through hybrid mode.

This application under Section 482 of Cr.P.C. has been filed by the Petitioner with a prayer to quash the order dated 17th October, 2003 passed by the learned S.D.J.M., Jagatsinghpur in G.R. Case No.128 of 2002 wherein cognizance has been taken of the offences under Sections 461, 379 read with Section 34 of the I.P.C. against him. 3.
Heard the learned counsel for the Petitioner and the learned counsel for the State-Opposite Party. 4.
Learned counsel for the Petitioner during course of argument submits that he does not want to press this petition since the Petitioner intends to surrender and move for bail before the court below. However, he submits that direction may be given to the court below to release the Petitioner on bail.

Considering the aforesaid submission of the learned counsel for the Petitioner, this CRLMC stands dismissed as not pressed.

However, since the Petitioner is ready and willing to surrender before the Court in seisin over the matter and makes a motion for bail, it is directed that if the Petitioner surrenders before the Court in seisin over the matter within six weeks hence and makes a motion for bail, the Court in seisin over the matter shall consider and dispose of the bail application of the Petitioner in accordance with law on the same day taking note of the fact that the Petitioner voluntarily surrendered and similarly situated co-accused persons have been released on bail.

Urgent certified copy of this order be granted on proper application.
