Heard learned counsel for the parties.

The Petitioner is an accused in connection with G.R. Case No. 219 of 2022 arising out of Nayagarh P.S. Case No. 43 of 2022 on the file of learned SDJM, Nayagarh registered for the alleged commission of offence under Sections 302/ 307/ 337/ 338/ 323/325/147/148/149 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. Sessions Judge, Nayagarh, by order dated 24.06.2022, the present BLAPL has been filed 5.
Taking in to account the release of the co-accused by this Court by order dated 12.07.2022 in BLAPL No. 5744 of 2022 and considering the submission of the learned counsel for the State, that the petitioner is prima facie similarly circumstanced with the person so released by this Court, this Court directs the petitioner
to be released on bail on such terms to be fixed by the court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
