Heard Mr. A. Sanganeria, learned counsel for the Petitioner and Mr. P.P. Mohanty, learned Addl. Government Advocate for the State-Opposite Parties.

The Petitioner has filed this Writ Petition with a prayer for issuance of a writ of mandamus to Opposite Party No.5-Executive Engineer, Rural Works Division, Jajpur to make calculation regarding BOQ Item No.11 of Agreement No.07P1 of 2019-20 for the work "Construction and maintenance of Baradai Chhaka (Sukinda Hatibari) R & B Road to Ankurpal Road via Solamania, Talangapatia, Dipasahi, Dhoudasahi Road" in square meter scale rate instead of cubic meter scale rate and to pay the differential amount with maintenance as claimed.

Having regard to the simple nature of prayer made, this Court disposes of the Writ Petition directing Opposite Party No.5Executive Engineer, Rural Works Division, Jajpur to make calculation as per the claim made by the Petitioner strictly in accordance with the terms and conditions of the agreement within

a period of four weeks from the date of receipt of a certified copy of this order.
