Mr. Dutta, learned advocate appears on behalf of petitioners (insurance company) and files additional affidavit pursuant to liberty obtained under order dated 13th September, 2022.

He submits, impugned is award dated 3rd December, 2016 of the Permanent Lok Adalat (PLA) awarding on death claim, where the Dead Life Assured (DLA) had misrepresented his age by producing PAN card, obtained four days prior to the proposal.

Mr. Satapathy, learned advocate appears on behalf of private opposite party. He submits, it would appear from the additional affidavit that PAN card is age proof accepted as standard by the insurance company, without reservation.

The additional affidavit discloses circular dated 29th June, 2015 effective 6th July, 2015. Entry 7 under standard age proof is PAN card. Admittedly, the DLA had relied on PAN card for disclosing age in the proposal form. The document had not been impeached before the PLA. In the circumstances, there cannot be interference in judicial review on impugned award.
