1. Petitioners, the proprietors of a business concern, namely, M/s. Yogamaya Traders are defaulting borrowers having availed an overdraft facility of Rs.15 lakhs on 14.5.2015 in the name of M/s. Yogamaya Traders and further having availed a housing loan of Rs.20 lakhs on 21.09.2015. The loan was secured by hypothecation of the paddy stock valued at Rs.28 lakhs and mortgaging a property in the name of the petitioners as well as their co-sharer Mr. Ranjan Kumar Sahoo.

2. A One Time Settlement against the two accounts, as aforesaid, was approved as per letter dated 09.02.2022 (Annexure-1 series) issued by the lending bank with the terms and conditions as indicated therein.

// 2 // Having failed to comply with the terms and conditions of the approved OTS, the petitioners have approached this Court by filing the present writ petition, inter alia, praying to provide further four months time for payment of OTS amount remaining unpaid.

3. When the matter is taken up today, at the outset, learned counsel appearing for the petitioner files a Memo dated 22.11.2022 stating therein that the petitioners do not want to press the writ petition, the said Memo is taken on record.

Accordingly, the writ petition is dismissed as not pressed.
