Heard Mr. Debaraj Mohanty, learned counsel for the petitioner and Mr. Ch. Satyajit Mishra, learned Additional Government Advocate.

On the oral prayer, Mr. Mohanty, learned counsel for the petitioner is permitted to implead Collector-cum-District Magistrate, Mayurbhanj as opposite party no.5. 3.

According to Mr. Mohanty, the petitioner who appears to be unmarried daughter of one late Narendra Patra is aggrieved by inaction of the authorities in not extending her benefits of resettlement under the Odisha Resettlement and Rehabilitation Policy, 2006 though such a benefit has been extended to her brother, namely, Sukanta Patra. He further submits though highlighting her grievances, he has filed a representation on 26.11.2021 under Annexure-5 series. However till date no action has been taken on the same and he prays that a direction be issued to the opposite party no.5 to take a decision on such representation within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Collector-cum-District Magistrate, Mayurbhanj (Opposite Party No.5) to take a decision on the above noted representation of the petitioner under Annexure-5 series in accordance with law within a period of three months from the date of receipt of certified copy of this order and communicate the result of such exercise to the petitioner. 5.

The writ petition is accordingly disposed of. 6.

Urgent certified copy of the order be granted on proper application.
