Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The Petitioner is an accused in connection with G.R. Case No.120 of 2021 arising out of Ranpur P.S. Case No. 69 of 2021 on the file of learned J.M.F.C.,Ranpur, registered for the alleged commission of offence under Sections 498-A/302/304B/34 of the I.P.C. 4.

Being aggrieved by the rejection of his application for bail U/s 439 Cr.P.C. by the learned Addl. Sessions Judge, Nayagarh by order dated 9.06.2021, the present BLAPL has been filed.

Perused the statement of one Narayan Sahoo, who is the brother-in-law of the petitioner, who stated that on the fateful day

the petitioner had called him to inform that his wife locked the door from inside and later on found the deceased was hanging by rope.

Such assertion is fortified by para-2 of the supervision note under the heading 'Deduction'.

It is also seen that the petitioner had taken the deceased to the hospital where she was pronounced dead. 8.

Considering the materials on record, the statement of the witness, the supervision note and the conduct of the petitioner post the occurrence, this Court directs that the petitioner shall be released on bail on such terms to be fixed by the learned court in seisin over the matter so as to ensure his presence on each date of trial.

Accordingly, the BLAPL stands disposed of.
