CONTC No. 3712 of 2021 Gobinda Ch. Samantray ....

Petitioner M/s. S. Das, Advocate -versusDr. P.S. Gahlaut and another ....

Opposite Parties/ Contemnors Mr. Karunakar Gaya, ASC Mr. S. Rath, Advocate CORAM: JUSTICE V. NARASINGH

ORDER

29.04.2022 Order No.

05.

1.

This matter is taken up through hybrid mode.

2.

Heard learned counsel for the petitioner and learned counsel for the Opposite party.

3.

Perused the show cause reply filed. The learned counsel for the petitioner submits that order of this Court dated 19.03.2021 has not been fully complied and this show cause is just a while wash to subvert the order of this Court.

4.

On a conspectus of materials on record, this Court finds that the manner in which the Opposite Parties have chosen to deal with the Departmental proceeding vis-a-vis the petitioner leaves much to be desired.

5.

Yet, being conscious of the limitations on powers of this Court in a contempt proceeding the present CONTC is disposed of

giving the petitioner liberty to assail the action of the authorities and filing afresh Writ Petition if so advised.

6.

Accordingly, this CONTC is disposed of.

7.

Urgent certified copy of this order be granted as per rules. (V. NARASINGH) Judge Santoshi
