This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for a direction to the Opposite Parties to release the amount of Rs.2,00,106/- along with interest to him without making any further delay. 3.
It is submitted by Mr. Panda, learned counsel that the Petitioner was the former Chief Executive of Badakainchi SCS. Due to some allegations, a sum of Rs.2,00,106/- has been held up by the PACS. But, subsequently, the Asst. Auditor General Cooperative Societies, Cuttack Audit Circle-II, Cuttack vide his letter dated 7th February, 2022 intimated that the Petitioner is entitled to refund of the said amount from the PACS. Although the Petitioner has made a representation to that effect before the Administrator of Badakainchi PACS on 25th February, 2022, but no action has yet been taken on the same. Hence, this writ petition has been filed.

In course of hearing, Mr. Panda, learned counsel for the Petitioner submits that the Petitioner has a remedy under the
// 2 // Odisha Co-operative Societies Act, 1962 for release of the said amount. Hence, he prays for withdrawal of the writ petition to avail the statutory remedy.

In view of the above, this writ petition is disposed of as withdrawn.
Urgent certified copy of this order be granted on proper application.
