Heard learned counsel for the Parties.

Learned counsel for the Petitioner is unable to show that the Petitioner has taken a ground before the original authority to stay her hand involving an exercise of OPLE Act for pendency of the R.P.Case No.408/2021, vide Annexure-4 before the Competent Authority involving the very same land. For a challenge to the order at Annexure-5 here and in absence of any particular, this Court finds, Annexure-5 is appealable. The Writ Petition is hence permitted to be withdrawn with liberty to the Petitioner, if so advised, may prefer appeal at least within a period of two weeks. There shall be status quo in respect of the disputed property for four weeks, within which period the Interlocutory Application accompanied the Appeal Memorandum shall be considered and disposed of.
