1. This is an application under Sec.439 Cr.P.C. for bail and the offences alleged are under Secs.20(b)(ii)(B)/25/29 of the NDPS Act for alleged possession of contraband ganja weighing 12 kg.

2. Heard Mr. P.S. Das, learned counsel for the Petitioner as well as Mr. B. Panigrahi, learned A.S.C. for the State-Opposite Party.

3. It is submitted that the Petitioner was earlier released on bail by order of this Court dated 03.03.2020 passed in BLAPL No.1258 of 2020. But subsequently due to his non-appearance before the learned trial court, NBW was issued and he was again taken to custody on 28.5.2022.

4. Upon hearing Mr. B. Panigrahi, learned Additional Standing Counsel for the State-Opposite Party and considering the fact that he was earlier released on bail, it is directed to release the Petitioner on bail in connection with Khallikote P.S. Case

No.43/2020 corresponding to G.R. Case No.2/2020 (N) on such terms and conditions to be fixed by the learned Addl. Sessions Judge-cum-Special Judge, Khallikote, Ganjam as he deems just and proper including the condition that the Petitioner shall attend the trial court on each date fixed.

5. The BLAPL is disposed of.

6. An urgent certified copy of this order be granted on proper application.
