02. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. M. Pati, learned counsel for the Petitioner and Mr. R.N. Mishra, learned AGA appearing for the Opp. Parties.

3. The Petitioner has filed the present writ Petition with the following prayer:- "The Petitioner therefore prays that your lordships may graciously be pleased to direct the Opp. Parties to update the service book and release all the retiral dues including the gratuity pension and pensionary benefits and also the admissible GPF dues.

And pass such order/directions as this Hon'ble Court may deem fit and proper.

And for this act of kindness, the Petitioner as in duty bound shall ever pray."

4. It is submitted that due to the suffering of the Petitioner from mental illness, he could not continue with his service and remanded on leave. But it is submitted that no proceeding was ever initiated against him for such absence of the Petitioner. As revealed from Annexure-3, B.D.O., Raghunathpur-O.P. No.4 submitted the service book and other documents for taking further action with

// 2 // regard to regularization of service to B.D.O., Sadar Cuttack/Nischitakoili.

5. It is submitted that subsequently though various communications have been made, but services of the Petitioner is yet to be regularized and thereby the Petitioner is deprived from getting the benefit of pension and other pensionary benefits.

6. In view of such, this Court permits the Petitioner to approach the O.P. No. 3 by making a detailed and comprehensive representation with regard to his grievances. It is observed that if such representation is filed within a period of two (2) weeks from today, O.P. No. 3 shall take a lawful decision on the same within a further period of three (3) months from the date of receipt of such representation.
