Heard Mr. P.S. Nayak, learned Central Government Counsel and Mr. N.R. Routray, learned counsel appearing for opposite party no.1.

Mr. N.R. Routray, learned counsel appearing for opposite party no.1 contended that the issue involved in this case has already been decided by the apex Court in the case of Shyam Babu Verma v. Union of India, (1994) 2 SCC 521. Therefore, this writ petition may be disposed of in the light of the aforesaid judgment.

In view of the above submission, as agreed to by learned counsel for the parties, this writ petition stands disposed of in terms of the judgment passed by the apex Court in the case of Shyam Babu Verma (supra).
