This matter is taken up through Hybrid Mode.

The petitioners are accused in connection with G.R. Case No.262 of 2022 arising out of Kalimela P.S. Case No. 139 of 2022, pending on the file of the learned J.MF.C., Motu for the alleged commission of offence under Sections-147 / 148 / 302 / 149/323of the IPC.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Malkangiri by Order dtd. 22.06.2022 in B.A. No. 84 of 2022, the present BLAPL has been filed.

Heard learned counsel for the petitioners and learned counsel for the State.

Taking into account on consideration that the learned Court in seisin over the matter was moved earlier and the chargesheet not having been filed, this Court is not inclined to entertain this application at this stage.

It shall be open to the petitioners to move the learned Courts below after filing of Final Form and the same shall be considered on its own merit without being influenced by the earlier Order passed or by the present order of this Court. 7.

The BLAPL accordingly stands disposed of.
