This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with G.R. Case No.298 of 2022 arising out of Aul P.S. Case No. 164 of 2022, pending on the file of the learned J.MF.C., Aul for the alleged commission of offence under Sections-458/395 of the IPC. 3.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Asst. Sessions Judge, Pattamundai by Order dtd. 22.06.2022 in Bail Application No. 130 of 2022, the present BLAPL has been filed. 4.

Heard learned counsel for the petitioner and learned counsel for the State.

Taking into account, on consideration that the learned Court in seisin over the matter was moved earlier and the chargesheet not having been filed, this Court is not inclined to entertain this application at this stage.

It shall be open to the petitioner to move the learned Courts below after filing of Final Form and the same shall be considered on its own merit without being influenced by the earlier Order passed or by the present order of this Court. 7.

The BLAPL accordingly stands disposed of.
