Mr. Satpathy, learned advocate appears on behalf of Order No.

petitioner and submits, his client had obtained allotment of land from Orissa Industrial Infrastructure Development Corporation (IDCO)/opposite party no.2. The intervenor established that a part of his land stood allotted to his client. In the circumstances, his client filed appeal, which was dealt with by impugned order dated 19th April, 2017. There was direction for refund to his client. However, his client thereafter has reason to believe that there may be a better way out. In the circumstances, his client has made the application, paragrarh-3 of which is reproduced below. "3. That, during pendency of writ petition several discussions have been made with regard to the allotment of alternate land as recommended by the Divisional Head and the Opp Party No.2 has finally agreed to Page of 2

consider the case of the Petitioner, being a business man and to keep cordial relationship with Opp Parties and it has been assured by the Authority to reconsider the case, the Petitioner does not want to proceed with the writ petition."

Mr. Pattnayak, learned advocate appears on behalf of IDCO, Mr. Nanda, learned advocate, Additional Government Advocate for State and Mr. Mohapatra, learned advocate for the intervenor.

On above averment in the application petitioner has prayed for withdrawal of the writ petition so that it does not stand in the way of it finding resolution of the problem with IDCO. The prayer made in the application is allowed. Interim order is vacated. 4.

The I.A. is disposed of.

The writ petition is thus disposed of.
