Heard Mr. C.R. Satapathy, learned counsel for the petitioner and Mr. D. Nayak, learned Additional Government Advocate.

According to Mr. Satapathy, the petitioner, who is a consumer vis-à-vis the P.D.S. Centre at Odasingh is aggrieved by the manner in which opposite party No.6, namely Bhagyadhara Pradhan, who has been appointed as a retailer is conducting the business of such centre.

Mr. D. Nayak submits that for such grievances, the petitioner should have approached the Sub-Collector, Cuttack (opposite party No.3) instead of rushing to this Court. 4.

In such background, Mr. Satapathy submits that liberty may be granted to the petitioner to approach the Sub-Collector, Cuttack (opposite party No.3) for redressal of his grievances by filing a grievance petition and prays that the said opposite party be directed to take a decision on such grievance petition within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to file a grievance petition before opposite party No.3 through registered post within a period of two weeks from today. In the event, such a petition is filed along with a copy of this order, the opposite party No.3 is directed to take a decision on the same in accordance with law within a period of six weeks from the date of receipt of such grievance petition after giving opportunity of hearing to the petitioner as well as opposite party No.6 and communicate the result of such exercise to the petitioner.

Accordingly, this writ petition is disposed of. 7.

Urgent certified copy of this order be granted on proper application.
