This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with C.T.Case No. 06 of 2021 arising out of Khatiguda P.S. Case No. 54 of 2020, pending on the file of the learned Sessions Judge-CumSpecial Judge, Nabarangpur for the alleged commission of offence under Sections-302/201/34 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge-Cum-Special Judge, Nabarangpur by Order dtd. 27.06.2022 in C.T. Case No. 06 of 2021, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Counsel for the State.

Learned counsel for the petitioner places reliance on the order passed by this Court dtd. 21.06.2022 in BLAPL No. 5276 of 2021 in respect of the co-accused and submits that she is similarly circumstanced and she be released on bail. 6.
Learned counsel for the State on the basis of recitals in the Case Diary stats that since the trial has commenced releasing the petitioner at this stage will affect the ongoing trial, 7.
Taking into account the release of the co-accused and that the petitioner's age (21), the period of custody, this Court directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter, to ensure that she appears on each date of trial. 8.
The Bail Application thus stands disposed of. 9.
