This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is seeking pre-arrest bail in connection with S.T. Case No.147 of 2019, arising out of Khantapada P.S. Case No. 80 of 2016 pending in the Court of learned Adhoc Addl. Sessions Judge (FTSC), Balasore for the alleged commission of offence punishable under Sections-376(1)(a)/417/ 312/ 201/ 109/ 294/ 506 of the I.P.C.

On perusal of the Order of rejection, it is seen that the petitioner being released on bail did not appear on the date fixed. The bail application was rejected on being committed to custody.

Taking into account the submission of the learned counsel for the petitioner that such lapse was for reasons beyond his control and not intentional, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter as deemed just and proper to initially his presence on each date of trial and additionally it is directed that he shall appear before the jurisdictional police station once every week till conclusion of the trial.

The violation of any of the conditions shall entail cancellation.

Accordingly, the ABLAPL stands disposed of.

Urgent certified copy of this order be granted as per rules.
