Heard learned counsel for the petitioner and learned counsel for the State.

Instant petition under Section 482 Cr.P.C. is filed by the petitioner challenging the criminal proceeding vis-à-vis the G.R. Case No.431 of 2013(T) pending in the file of First Additional Sessions Judge-cum-Special Judge, Berhampur, Ganjam on the grounds stated therein.

However, in course of hearing, the learned counsel for the petitioner submits that the petition may be disposed of with a liberty to raise the grounds at the time of framing of charge before the court below.

In view of the above submission, the CRLMC stands disposed granting liberty to the petitioner to file a discharge petition before the court below on the grounds which have been raised before this Court and in the event, it is so moved, the court concerned shall do well to

pass appropriate order as per and in accordance with law which shall obviously be after providing an opportunity hearing to him. (R.K. Pattanaik) Judge TUDU
