ORDER
Order No.
06.07.2022 2.
1.
This matter is taken up through Hybrid mode.
2.
Petitioner in this writ petition prays for a direction to cancel the result of the election of Bilipada Cooperative Society Limited, Banki so far as it relates to zone No.7. 3.
Upon hearing learned counsel for the Petitioner and Mr. Dhal, learned counsel appearing on behalf of State Cooperative Election Commission, this Court is of the considered opinion that since the Petitioner has not exercised his right under Rule 45 of the Odisha Cooperative Societies (Election to the Committees) Rules, 1992, he has remedy to file election dispute before learned State Cooperative Tribunal.
// 2 // 4.
In that view of the matter, this Court is not inclined to entertain this writ petition. Accordingly, the writ petition is disposed of with an observation that if the Petitioner so advised may move the State Cooperative Tribunal by filing a properly constituted election dispute as delineated in this writ petition.
