Heard learned counsel for the parties.

The Petitioner is an accused in G.R. Case No. 753 of 2020(C.T. Case No. 6 of 2021) arising out of Khatiguda P.S. Case No. 54 of 2020 on the file of learned Sessions Judge-cumSpecial Judge, Nabrangpur for the alleged commission of offence under Sections 306/201/34 of the I.P.C. The petitioner is in custody since 2.09.2020.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Nabarangpur by order dated 10.05.2021, in the aforementioned case, the present BLAPL has been filed. 5.

Considering the submission of the learned counsel for the State on the basis of recitals in the case diary that the basis of

implication is extrajudicial confession and circumstantial evidence, this Court directs that the petitioner shall be released on bail. The learned court in seisin over the matter to fix the terms. 6.

Accordingly, the BLAPL stands disposed of.
