This matter is taken up through hybrid mode.

The Petitioners in this CMP seek to assail the order dated 17th May, 2022 passed by learned Additional Civil Judge (Senior Division), Talcher in C.S. No.15 of 2017, whereby he rejected an application filed by the present Petitioner under Order VII Rule 11 C.P.C.

In course of hearing, Mr. Sahoo, learned counsel for the Petitioners prays for withdrawal of the CMP submitting that the impugned order is revisable under Section 115 of C.P.C. 4.

In view of such submission, the CMP is disposed of as withdrawn.

Certified copy of the impugned order shall be returned to the learned counsel for the Petitioners on substitution of attested photocopy thereof.

Urgent certified copy of this order be granted on proper application.
