Heard learned counsel for the petitioner and learned Addl. Government Advocate for the State.

The petitioner has approached this Court seeking the following relief.

"It is, therefore, prayed that this Hon'ble Court would graciously be pleased to admit this writ petition, call for the records and issue a writ in the nature of mandamus;

i) Directing the Opposite Parties to continue to extend full salary cost to the petitioner as part of Grant-inAid from the date of his joining, i.e. 16/10/1992; ii) Directing the opposite parties to extend all the consequential service benefits;

And pass any other appropriate order/orders, writ/writs, direction/directions as this Hon'ble court may deem just and proper in the interest of justice, And for this act of kindness the petitioner as in duty bound shall ever pray."

In course of hearing it is submitted that ventilating the same grievance, the petitioner has approached the Principal Secretary, Higher Education Department, Govt. of Odisha by submitting a representation on 16.10.2019 followed by another representation on 24.02.2021 as also a representation to the Director, Higher Education Department on 24.02.2021.

Since a decision is to be taken on the grievance of the petitioner by the authority at first instance, without expressing any opinion on the merits of the case, the writ petition is disposed of with a direction to opposite party No.1 to consider the representation submitted by the petitioner and to pass an order in accordance with law after granting opportunity of hearing to the petitioner within a period of four weeks from the date of communication of this order or on production of certified copy by the petitioner.
