This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in S.T. Case No.19 of 2021, on the files of learned 3rd Additional Sessions Judge, Balasore, arising out of Basta P.S. Case No.410 of 2019, under Sections 341/294/354/302/506/34 of IPC.

Taking into account the statement of son of the deceased namely Dayanidhi Mohapatra, this Court is not inclined to entertain this bail application.

Since the petitioner is stated to be in custody since 07.11.2020, learned Court below in seisin over the matter shall do well to expedite the trial and the petitioner is at liberty to ventilate his grievance after examination of son of the deceased namely Dayanidhi Mohapatra.

Giving such liberty the BLAPL stands disposed of. 7.
