This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.3721 of 2022, on the files of learned S.D.J.M. Bhubaneswar, arising out of Mancheswar P.S. Case No.205 of 2022, under Sections 394/34 of IPC and is in custody since 22.06.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned District & Sessions Judge (K), Bhubaneswar, by order dated 30.06.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of the learned S.D.J.M. dated 23.06.2022 in C.T. Case No.3721 of 2022.

Learned S.D.J.M. while rejecting the bail application of the present petitioner who was one of the accused has taken note that the matter has been amicably settled between the Parties. 7.

Learned counsel for the petitioner submits that in the meanwhile accused namely Silu Mishra has already been released on bail by the learned Sessions Judge by order dated 23.07.2022 in BLAPL No.1217 of 2022.

Taking note of the compromise as noted by the learned Magistrate and release of the co-accused as submitted by the learned counsel for the petitioner, this Court directs the petitioner to be released on bail. Learned Court in seisin over the matter to fix the terms.

While so doing, the veracity of the submission of release of the co-accused be verified, if it comes to fore that the co-accused has not been released as submitted, this order shall stands recalled. 10.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
