ORDER (Oral) 09.02.2022 1.

1. This matter is taken up through hybrid mode.

2. Instant contempt petition has been filed with the allegation that the interim order dated 8th December, 2016 passed in the main case has been willfully violated inasmuch as the charge of administering Oriya Bazar Mosque has not been handed over to the Chief Executive Officer of the Odisha Board of Waqf by the contemnors-O.Ps.1 & 2.

3. We have perused the record of W.P.(C) No.18519 of 2016 wherein final order dated 28th March, 2017 stands passed relegating the parties to seek fresh remedy before the Tribunal constituted under Section 83(2) of the Waqf Act, 1995.

4. The aforesaid interim order having merged with the final order, we are not inclined to pursue the present contempt.

5. In view of the above, the contempt proceeding is dropped.
