This matter is taken up through Hybrid arrangement (video conferencing/physical mode). Heard learned counsel for the petitioner and learned counsel for the State.

This is an application under section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in connection with Jaipatna P.S. Case No.48 of 2021 corresponding to C.T. Case No.45 of 2021 pending in the Court of learned J.M.F.C., Jaipatna for alleged commission of offence under section 408 of the Indian Penal Code.

Perused the F.I.R. annexed to the anticipatory bail application.

// 2 // Considering the submission made by the learned counsel for the petitioner that the implication of the petitioner is based on the confessional statement of the co-accused before police, the offence is triable by Magistrate and the fact that the petitioner has been granted interim protection since 22.07.2021 and there is no material that he has misutilized his liberty and on hearing the learned counsel for the State, the interim order dated 22.07.2021 is made absolute. The ABLAPL is accordingly disposed of.

Issue urgent certified copy as per Rules.
