Heard Mr. R.K. Acharya, learned counsel for the petitioner, Mr. D.R. Bhokta, learned Central Government Counsel and Mr. D.K. Mohanty, learned Additional Standing Counsel.

According to Mr. Acharya, the petitioner is aggrieved by the inaction of the authorities in paying him just and fair compensation at present market rate by following due process of law as his land viz Plot No.201/360 covering an area of Ac.1.00 decimals pertaining to Khata No.48/1 under Mouza - Falpaju in the district of Nayagarh has been acquired for construction of Khurda - Bolangir Rail Line Project. He further submits that though highlighting all his grievances, the petitioner has filed a representation on 22.06.2022 under Annexure-2 before the Collector & District Magistrate, Nayagarh (opposite party No.2)

// 2 // through registered post on 23.06.2022 however, till date nothing has been done in the matter. In such background, he prays that that a direction be issued to the Collector and District Magistrate, Nayagarh to take a decision on the above noted representation within a specific time period. 3.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Collector and District Magistrate, Nayagarh (opposite party No.2) to take a decision on the above noted representation of the petitioner under Annexure-2 in accordance with law within a period of three months from the date of receipt of a certified copy of this order and communicate the result of such exercise to the petitioner.

Accordingly, this writ petition is disposed of. 5.

Urgent certified copy of this order be granted on proper application in course of the day.
