Heard learned counsel for the petitioner, learned Counsel for the State and learned counsel for the informant. 3.

The petitioner is an accused in connection with G.R. Case No. 219 of 2022 arising out of Nayagarh P.S. Case No. 43 of 2022, pending on the file of the learned S.D.J.M., Nayagarh for the alleged commission of offence under Sections302/307/337/338/323/325/147/148/149 of the I.P.C. 4.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge, Nayagarh, by Order dtd. 21.06.2022 in B.A No.83/192 of 2022, the present BLAPL has been filed.

Taking into account the release of the co-accused by this Court by Order dtd. 12.07.2022 in BLAPL No. 5744 of 2022 and

considering the submission of the learned counsel for the State, that the petitioner is prima facie similarly circumstanced with the person so released by this Court, it is directed the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.
