This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. (Spl.) Case No.31 of 2021, pending in the file of learned District and Sessions Judge, Cuttack, arising out of Lalbag P.S. Case No.299 of 2021, offence under Sections 21(C) of NDPS Act and is in custody since 26.11.2021.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Special Judge, Cuttack by order dated 23.12.2021 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner is permitted to withdraw the bail application. Accordingly the BLAPL stands disposed of as withdrawn.

Since the petitioner is in custody since 26.11.2021, learned Court in seisin is called upon to conclude the trial within the period

of four months from the date of receipt/production of certified copy of this order.
