This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with 2(b)C.C. Case No. 14 of 2022 arising out of O.R. Case No. 91(B) of 202223, pending on the file of the learned SDJM, Boudh for the alleged commission of offence under Section-51 of Wild Life Protection Act, 1972.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned District & Sessions Judge, Boudh by Order dtd. 24.06.2022 in BLAPL No. 44 of 2022, the present BLAPL has been filed.

Heard learned counsel for the petitioner and learned Counsel for the State.

Taking into account the nature of allegation and the period of custody and considering the submission of the learned counsel for the petitioner that he has no criminal proclivity, this Court directs the petitioner to be released on bail on such terms and conditions to be fixed by the learned Court in seisin over the matter and also verify the veracity of the statement that the petitioner has no criminal antecedents.

If it comes to the fore that the petitioner has any criminal antecedents, this order shall stand recalled. 7.
With the additional stipulation that the petitioner shall appear before the jurisdictional Police Station once every week till submission of the Final Form.

The Bail Application thus stands disposed of. 9.
