Petitioners in this CMP seek to assail the order dated 18th May, 2002 (Annexure-6) passed by learned Civil Judge (Senior Division), Balasore in IA No.717/873 of 2021 (arising out of CS2172/2480 of 2021), whereby he rejected an application under Order XXXIX Rule 7 CPC filed by the Petitioners.

In course of hearing, Mr. Mohanty, learned counsel for the Petitioners submits that interest of justice will be best served if the Petitioners adduce evidence in the petition under Order XXXIX Rules 1 and 2 CPC in support of his case and prays for withdrawal of the CMP.
