This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with Special 2(a) C.C. Case No.11 of 2022 arising out of P.R. No.17 of 202223, pending on the file of the learned Sessions Judge-Cum-Special Judge, Malkangiri for the alleged commission of offence under Section- 20(b)(ii)(C) of the N.D.P.S. Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Judge-Cum-Special Judge, Malkangiri by Order dtd. 22.06.2022 in Special 2(a) C.C. Case No.11 of 2022, the present BLAPL has been filed. 4.
Heard learned counsel for the petitioner and learned Counsel for the State.

Taking into account that the contraband (Ganja) seized is to the tune of 6 Kg. Less than the commercial quantity and the period of custody, this Court directs the petitioner to be released
on bail, on such terms and conditions to be fixed by the learned Court in seisin over the matter including the additional stipulation that one of the sureties shall be the immediate family member of the petitioner and the petitioner shall appear before the jurisdictional police station once every fifteen (15) days till filing of Final Form, the first date of such appearance to be fixed by the learned Court in Seisin over the matter.

It is needless to state that violation of any conditions relating to appearance shall entail cancellation of bail. 7.
The Bail Application thus stands disposed of. 8.
