This writ petition involves the following prayer:- "It is therefore humbly prayed that, this Hon'ble Court may graciously be pleased to admit this writ petition and after hearing the parties direct the Opp. Parties more particularly the Opp. Party No-2 to construct the core house allotted to the petitioner as per the modified proposed plan submitted by the petitioner, the extra cost of which are to be borne by the petitioner.

And pass such other order/orders, direction/directions, as deem fit and proper in the facts and circumstances of the case;"

Reducing the prayer made in this writ petition, Mr. Palit, learned Sr. Advocate appearing on behalf of the Petitioner in reference to the document at Annexure-4 more particularly at page 18 of the brief, contended that for there is requirement of slight readjustment involving construction of the core house in question by the Odisha State Housing Board, but at the cost of the Petitioner, the Petitioner though made a request for realignment of the structure vide Annexure-4, but no decision has been taken thereon as yet.

This Court finds, the application involved was made by the Petitioner on 17.05.2022. Considering this to be a pending case, this Court declines to entertain the writ petition for the same being premature at this stage. However, considering the submission of Mr. Palit, learned Sr. Advocate appearing on behalf of the Petitioners, this Court directs the Opposite Party No.2 to look into the request of the Petitioner vide Annexure-4 and take a lawful decision on the same also involving the Petitioner. For the nature of request involved herein, a final decision shall be taken in the matter within a period of one month from the date of communication of an authenticated copy of this order by the Petitioner. 4.
