Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner has approached this Court seeking the following relief:

"That the petitioner therefore prays that this Hon'ble court may graciously be pleased to admit this Writ petition, Issue notice to opposite parties.

By considering the facts and grounds stated above the opposite parties may direct to allow the petitioner to join in her service as GRS in Dutimendi Gram Panchayat under the D.R.D.A., Kandhamal."

The petitioner was initially engaged as a Multi Purpose Assistant (Gram Rozgar Sevak) vide order dated 23.11.2007 on consolidated remuneration of Rs.2000/- per month. It is submitted that because of her illness she was granted leave for one month from 11.11.2014 to 10.12.2014 on 'no work no pay' basis. The said leave was also said to have been extended from 11.12.2014. The petitioner claims to have been medically treated for her illness because of which she could not join in her duties despite expiry of the period of leave. Further, because of her continued illness, she

remained absent for as long as eight years and thereafter wanted to join but was not allowed to do so. It is submitted that the petitioner has approached the concerned authority on several occasions making the above request but the same has not been considered as yet.

Considering the submissions as above, the writ petition is disposed of granting liberty to the petitioner to submit a fresh representation to the Collector, Kalahandi raising all such grounds as are available to her in law. In the event such representation is filed within two weeks, the same shall be considered and disposed of by passing a lawful order within a period of two weeks thereafter. It is made clear that this Court has not expressed any opinion on the merits of the case.

Writ petition is disposed of accordingly.
