Heard learned counsel for the Parties.

This Writ Petition involves a serious allegation of no improvement in the road condition in the locality involved. Through the photographs, it has been brought to the notice of the Court that the road condition is in such a miserable situation that even no walking on the road is possible, which is also established through the photographs appended herein.

Considering the serious allegation, notice was issued directing the Cuttack Municipal Corporation by way of service of copy. Mr.D.K.Nayak, learned counsel for the CMC was also to take instruction by the next date. Today on instruction Mr.D.K.Nayak, learned counsel for the Cuttack Municipal Corporation submits, there has been some sort of objection by the locality in the quality of
// 2 // the road undertaken. Considering such objection in the meantime, the Cuttack Municipal Corporation has come to resolve to make a concrete road instead of Paver Block and resolution since already passed, the Corporation is undertaking the auction process and undertaking to complete the road as early as possible. 4.
Considering the development in the change in the material position of the road involved public demand getting the road work inordinately delayed, this Court in disposal of the Writ Petition directs the Cuttack Municipal Corporation to bring the road at least to a habitable condition to have the minimum passage facility at least till a concrete road is permanently constructed. The concrete work of the road is also directed to be completed at least within a period of three months. Till providing a permanently constructed road, it becomes the responsibility of the Cuttack Municipal Corporation to see that there is normal thoroughfare in the locality undertaking temporary measures required, if any.
