Heard learned counsel for the petitioner and learned Counsel for the State.

The petitioner is an accused in connection with 2(a) C.C. Case No.4 of 2022(NDPS) arising out of P.R. No.23 of 2022-23, pending on the file of the learned Addl. District & Sessions Judgecum-Special Judge, Kantamal for the alleged commission of offence under Section- 20(b)(ii)(B) of the N.D.P.S. Act. 4.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. District & Sessions Judge-cum-Special Judge, Kantamal by Order dtd. 29.06.2022 in 2(a) C.C. Case No.4 of 2022(NDPS), the present BLAPL has been filed.

Taking into account that the seizure of the contraband to the tune of 10 Kgs 500 grams from the petitioner and release of the co-accused, as submitted by the learned counsel for the petitioner, this Court directs the petitioner to be released on bail, on such terms and conditions to be fixed by the learned Court in seisin over the matter including the additional stipulation that the petitioner shall appear before the Trial Court on each date of trial. 6.

It is needless to state that violation of any conditions relating to appearance shall entail cancellation of bail. 7.

The Bail Application thus stands disposed of. 8.
