This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

Learned counsel Mr. S.N. Mishra, appearing for the informant being engaged by the High Court Legal Services committee.

The petitioner is an accused in G.R. Case No.39 of 2022(POCSO), pending in the file of learned Additional District Judge-cum-Spl. Court under POCSO Act, Berhampur, arising out of Aska P.S.

Case No.151 of 2022, under Section 458/354(A)(1)(ii)/354(B) of the IPC along with 8 of POCSO Act and is in custody since 28.03.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District Judge-cumSpecial Court under POCSO Act, Berhampur by order dated

20.06.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the nature of allegations, this Court is not inclined to entertain this bail application at this stage. It shall be open to the petitioner to renew his prayer after the examination of the victim.

Accordingly, the BLAPL stands disposed of.
