Petitioner is the auction purchaser of a Order No.

mortgaged property sold by the SBI, Stressed Assets Recovery Branch, Bhubaneswar in the auction sale towards recovery of outstanding liabilities of M/s. Basudev Stones, a proprietorship concern of Janaki Ballav Pattnaik. The petitioner claims that upon deposit of the entire sale consideration, a sale certificate was issued in favour of the petitioner along with actual possession delivered.

The limited prayer by the auction purchaser is for a direction to the secured creditor/Bank to remove the articles/items lying in the unit purchased by the Petitioner-auction purchaser, in terms of the letter issued by the Bank itself.

At the time of hearing, learned counsel for the petitioner states that in view of a settlement, the petitioner wants to withdraw the present writ petition.

To that effect a memo has been filed.
