This matter is taken up through Hybrid Mode.

Heard learned counsel for the petitioner and learned Counsel for the State.

The petitioner is an accused in connection with C.T. Case No. 555 of 2021 arising out of Chandipur P.S. 56 of 2021, pending on the file of the learned S.D.J.M., Balasore for the alleged commission of offence under Sections-272, 273, 34 of the I.P.C. read with Section -52(a) of Odisha Excise Act. 4.
Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Special Judge(Vigilance), Balasore by Order dtd. 30.06.2022 in Bail Application No. 652 of 2022, the present BLAPL has been filed.

Taking into account the release of co-accused similarly circumstanced by Order dtd. 26.08.2022 in BLAPL No. 6725 of
2021 and order dtd. 14.03.2022 in BLAPL No. 1534 of 2022, this Court directs the petitioner to be released on bail, on such terms and conditions to be fixed by the learned Court in seisin over the matter.
