Mr. A.C. Panda, learned counsel for the petitioner states that in the meantime the work has already been over and, therefore, by efflux of time the writ petition has become infructuous. So far as the final bill and refund of EMD is concerned, the petitioner may be granted liberty to pursue his remedy before the appropriate forum in terms of the DTCN/agreement itself.

In view of the above submission, the writ petition stands disposed of with the liberty aforesaid.
