This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with G.R. Case No. 246 of 2022 arising out of Kabisuryanagar P.S. Case No. 250 of 2022, pending on the file of the learned J.M.F.C., Kabisuryanagar, Ganjam for the alleged commission of offence under Sections-52 (a) Odisha Excise Act.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Additional District & Sessions Judge, Kodala, Ganjam by Order dtd. 27.06.2022 in Bail Application No. 137 of 2022, the present BLAPL has been filed. 4.

Heard learned counsel for the petitioner and learned Counsel for the State.

Taking into account the seizure of 525Kgs 600 grams of 'Bhanga' and the period of custody since 13.06.2022, this Court directs the petitioner to be released on bail on such terms and

conditions to be fixed by the learned Court in seisin over the matter, including that the petitioner shall appear before the concerned Police Station once every ten (10) days, the first date and time to be fixed by the Court below.

The violation of any of the conditions shall entail cancellation.
