Grievance of the Petitioner in this writ petition is with regard to inaction of the Secretary, STA, Odisha, Cuttack to consider and dispose of his application for modification of the timing in down trip, as directed by the Deputy Secretary, STA, Cuttack, vide its order dated 26th August, 2021(Annexure-3). 3.
It is submitted by learned counsel for the Petitioner that although his application is pending since 1st November, 2021 (Annexure-4) the authority no decision has yet been taken on the same for which the Petitioner is not in a position to operate his vehicle bearing registration No.OD-04-N-2458 (Bus) (state carriage).

Mr. Behera, learned Standing Counsel for Transport Department submits that he has no instruction in the matter. However, if the application under Annexure-4 is still pending with the Secretary, STA, Cuttack, he may take a decision on the same in accordance with law.

Taking into consideration the submissions of learned counsel for the parties, this Court, without expressing any opinion on the merits of the case of the Petitioner, disposes of the writ petition with a direction that on production of certified copy of this order along with a copy of application under Annexure-4 within a period of two weeks hence, the Secretary, STA, Cuttack - Opposite Party No.2 shall do well to take a decision on the same, as expeditiously as possible, preferably within a period of one month therefrom giving opportunity of hearing to the parties concerned.
Issue urgent certified copy of the order on proper application.
