The order dated 23.06.2017 passed by the learned J.M.F.C., Kabisuryanagar, District-Ganjam in G.R. Case No. 105/2017 issuing N.B.W. of arrest against the petitioner has been challenged in this application. Mr. Santosh Ku. Mahanty, learned counsel for the petitioner states that the matter has been settled between the informant and the accused persons in the meanwhile and the co-accused persons namely, Airendri Karan, British Karan and Smt. Bangali Karan have been released on bail on 27.05.2017 and there is no allegation under Section 307 of IPC against the petitioner who is a housewife for which she should be released on bail. I am not inclined to allow the prayer for bail in an application under Section 482 of Cr.P.C., but considering the allegations against the petitioner and the circumstances of the case, it is directed that if the petitioner surrenders before the learned J.M.F.C., Kabisuryanagar, District-Ganjam in G.R. Case No. 105/2017 arising out of Kabisuryanagar P.S. Case No. 68/2017 within a period of four weeks from today and files an application for bail, the same

// 2 // shall be considered on the same day keeping in view the settlement between the parties and the release of the co-accused persons on bail and whether an offence under Section 307 of IPC is made out against the petitioner. It is further directed that the application for bail shall be disposed of in the first hour so as to enable the petitioner to move the learned Additional District Judge, Kodala for bail on the same day in the event of rejection of her prayer by the learned J.M.F.C.

With the aforesaid observation, the CRLMC is disposed of. Urgent certified copy of this order be granted on proper application.
